Race and Sex Discrimination

“Discrimination is a plague that hamstrings corporate productivity and steals the dignity of all mankind. Is that a definition of ‘Un-American’?”

The prototypical discrimination claim is for race discrimination or sex discrimination. The first anti-discrimination laws passed in this country were directed at race discrimination, which now includes both employment discrimination and housing discrimination. 42 U.S.C. §1981 which prohibits race discrimination in the making and performance of contracts was passed shortly after the Civil War. Because employment is a kind of contract, the employment lawyer uses §1981 to pursue race discrimination and wrongful termination cases. Title VII was note passed until the early 1960’s and was the first federal law to address sex discrimination in the context of employment. Putting aside sexual harassment law which grew out of Title VII, race and sex discrimination claims are handled in a very similar manner using either the direct or indirect method of proof.

In the context of employment discrimination, race and sex discrimination come in many forms including: denial of overtime work, denial of or limited bonuses, wrongful termination (although wrongful termination claims are more typical in race discrimination than sex discrimination cases), poor evaluations, differential discipline, and even outright harassment. The key to any kind of employment discrimination claim is that the victim is of a particular race and sex. (A man or a white person could just as easily have a reverse discrimination claim is a woman or an African-American commits the discrimination).

How come you guys ignore Jewishness and antisemitism. Antisemitism is one of the forms of racism which has produced the worst of results (i.e., the Shoah). Yet too often when race is discussed in America it is just assumed that Jews are simply white. Why? Especially when we Jews have been among racism's most popular victims.

Growing up in a mostly white society, I do not have the first hand experience when dealing with sexism or racism, although I know some people who have, and who have shared their experiences with me. When I was told how they were treated, or how they were looked at because of being a women, and because they were not "white" it made me furious.

     After reading this blog, i did not fully understand until I read it a few more times. To me I don't see how you can have a law and than grow out of it? that makes no sense. When a law is passed, it should stay passed, and not be "out grown." I think that no matter what you look like, what race you are or what your gender is, you should have the same rights as everyone else. Employers shouldn't be able to fire you or let you go based off your race or gender.

  Alot of things in the world today are not equal, and are not fair, but I think that racial and sexual discrimination are two things that should be the most important, and focused on, if this is not fixed or does not change, it will only cause more problems in the near future, everyone deserves fair treatment and an explanation for either being fired in the workplace, or not being allowed to move in somewhere based off racial discrimination and sexism and that should not even be an issue in the first place. this topic is so frustrating because it seems you try so hard, and get nothing in return.

     I feel as an African American women white people have privilege every day of their life and never realized that they do. White privilege put them at a advantage over other races. I feel whites are carefully taught not to recognize white privilege.

   White privilege gives whites the upper hand in getting visas, passports, cloths and so much more. As for me all these things would be question before I could get them. As an African American if I wanted to be in a company of people of my race most of the time this would not be available for me to do so. As well as watching the television or opening the newpaper and seeing people of my race represented. As a white person these simple things mean something different to people of another race.

    When you usually here the word privilege you think of males privilege. Yet white privilege opens many doors for white wheather it's right or wrong. If these things are true about white privilege then this is not a free country that we live in. If one race is not having more privilege over the other than Americans wouldn't know what to do. Somebody always feels their better than the other even if their are no real differences.

    As a white woman in America, I am discriminated against not because of my race, but because of my gender.  Each day, I am slapped with statistics about how white males have historically, and probably will continue, to earn higher wages than I will.  Even now, in our so-called "advanced" society, it is still difficult for women to reach elite positions in society specifically because of their gender.

    I, however, have an unwritten advantage over others.  I, for the most part, do not have to worry about issues of race holding me back.  It surprises me that after major milestones in our country such as the Civil War, slavery, and the Civil Rights Movement, this country is still divided on the basis of race.  Our country prides itself on being "the melting pot of the world," so why is it that some still use race and ethnicity as a discriminating factor?

    It seems unreal to me in a country that flaunts its freedom and equality that we are so UNEQUAL and thus our freedom as human beings is restricted.  Whether you are discriminated against because of your sex, race, class, or disability, making it in this world suddenly becomes a lot harder.  While I agree that it shouldn't be an issue at all, we have to realize that it is a big issue in this country at this time.  We have to look out for anything we can do to open the minds of the people around us and prove ourselves.

Sexism and racism is a big problem that has been going on for a long time, but it has not been giving the importance that it deserves. As a female and minority I know that it does not matter how many achievements I earn, I won’t ever get as far as a white person or a male would, and this is just because I am a woman of color. It makes me sad that this country is known for it is great diversity and equal opportunity, yet it is an extremely racist country.

I think that racism in this country grows more everyday take for example, this year in Michigan proposal 2 passed which I think was dumb, it is kind of weird that there is a large group of people who are minorities and still proposal 2 passed this just makes me think that probably a lot of white people voted for it to pass.

Majority of white people were glad that proposal 2 passed because according to them minorities were getting special treatments and they were feeling discriminated against for being white. But the people, who voted for proposal 2 to pass, don’t think of the “white privilege” that they have. White people have many privileges just for being white for example, they don’t have too worry about their race being a problem to get hired in a job or for the employer to use their accent as an excuse to not hire them. I think that racism should be looked at a much closer view and that differences should be appreciated instead of judged.

   As a colored woman I face many struggles in our society. One I am a woman and two I am colored, for those two qualities of which I can not change I know that it does not matter how many achievements I earn I will never earn as much recognition as a white female or male of any race. It is very sad that in our society in the 21st century there still continues to devaluation of woman and a lot of racism.

I believe that woman in general face many problems just for the fact of being a woman. There are always a number of things that an employer can use as an excuse not to hire a woman such as “the job is too heavy for you” or “you will only distract the employees from doing their job”. And being a minority I also have a disadvantage for example, a white female does not have to worry about an employer not hiring her due to accent or because of their color.

   Many men still believe that women are meant to be home with the kids and cleaning, this is an image that is completely sexist in my opinion. I also think that the media reinforces sexism or devaluation of woman, take the music videos for example, they portrait women as nothing more than a sexual tool. This is an image that needs to change.

Perhaps what we should be addressing is not sex discrimination but gender discrimination.  After all, when folks discriminate they usually don't take the time to check for the chromosomal sex.  They go on the outward appearance and social behavior (that's gender folks).

This also addresses the fact that a man living as a woman might be discriminated against in ways similar to biological women.

Usually when discussing this in a social context one would use the term gender.  Sex is usually used in a medical or biological sense.

I am colored man, have been experiencing all sorts of discriminations in my life and believe that such an unhealthy acts is only practised and controlled by small elite unwise group, who was put there by their manupulation of the systems.

These group is only temporary there and we must continue to voice out these unhealthy human practices. They must be removed by force, and no other ways as these people are thick skin and do not feel embarrassment of their own evil acts.
